Environmental Protection Act Amendments – Public Consultation

Overview

As Western Australia’s primary environmental protection legislation, the Environmental Protection Act 1986 (EP Act) provides the legal framework for environmental impact assessments conducted by the EPA.

Amendments to the EP Act were passed by the Western Australian Parliament in November 2020. Amendments relating to Part IV of the EP Act are scheduled to come into force in August 2021. To implement the amendments, the EPA has revised its Environmental Impact Assessment (EIA) procedures suite.

The EPA is seeking your views on operational and practicability issues associated with revisions to its EIA procedures suites. In particular, how they affect the following:

  • Achievement of environmental protection
  • Efficient processes
  • Transparency
  • Proportionality of information – information needs are dependent on the nature and risk of impacts

The EPA is using ten key principles to inform key EIA matters and revision of the EIA procedures suite. The EPA is providing these to aid consultation.

The EPA has formulated 10 key questions to guide consultation on the EIA procedures suite. The EPA is providing these to aid consultation.

The EPA has also prepared guidance on how changes may affect you through ten possible scenarios.

Why we are consulting

The EPA has revised its EIA procedures suite to implement changes to the EP Act that will come into force in August 2021. The EPA is focused on implementing changes that will result in efficient process and strong environmental protection outcomes.

A central aspect of providing better environmental outcomes and more efficient processes is to increase clarity and consistency on key EIA matters for EPA Services, stakeholders and proponents.

 

This is your chance to provide your views on the primary revised procedures documents and help ensure that they deliver efficient processes and strong environmental protection outcomes.
